1. SERVICE:

FollowDesk is an AI-powered SMS follow-up platform for businesses.

2. ACCOUNTS:

Must be 18+, provide accurate info, maintain account security.

3. ACCEPTABLE USE — You agree to:

• Obtain proper consent before sending SMS
• Comply with TCPA, CAN-SPAM, all applicable laws
• Not send to opted-out contacts
• Not use for illegal/deceptive purposes
• Not send spam
• Honor all opt-out requests immediately

4. SMS TERMS:

• Explicit prior consent required from each recipient
• STOP replies immediately unsubscribe — do not re-subscribe without new consent
• You're responsible for all content sent
• Disclose expected message frequency at opt-in (typically 1-10 per sequence)
• Standard message and data rates may apply — disclose at opt-in

5. PRICING:

• Free: 50 contacts, 1 sequence
• Pro: $49/mo — unlimited contacts, sequences, AI personalization, reply detection
• Agency: $149/mo — everything in Pro + 5 team members, shared inbox, custom branding
• Payments via Stripe, auto-renew, cancel anytime, no cancellation fees
• Annual plans: 15% discount (2 months free)

6. REFUNDS:

Case-by-case within 14 days. Contact support@followdesk.org

7. AVAILABILITY:

We strive for high availability but don't guarantee 100% uptime.

8. PRIVACY:

Subject to Privacy Policy at followdesk.org/privacy

9. IP:

FollowDesk branding, code, content owned by Framewrk. No copying/reverse-engineering.

10. TERMINATION:

We may suspend accounts violating these Terms. You may cancel anytime.

11. LIABILITY:

Provided "as is." Not liable for lost revenue, SMS delivery failures, third-party outages. Total liability capped at 12 months of payments.

12. INDEMNIFICATION:

You agree to hold harmless Framewrk/FollowDesk from claims arising from your use.

13. CHANGES:

We may update Terms. Continued use = acceptance.

14. GOVERNING LAW:

Commonwealth of Virginia, United States.
